TAFE Tasmania Act

The Act came into effect on 1 January 1998.

PURPOSE OF ACT

The purpose of this Act is to establish TAFE Tasmania as an independent statutory authority with body corporate powers. TAFE Tasmania provides vocational and further education, including adult education, and provides services for students in relation to vocational and further education.

MAIN PROVISIONS OF THE ACT

The Act:

" " enables the creation of TAFE Tasmania as a body corporate with perpetual succession, which is able to sue and be sued in its own name. The authority is an instrumentality of the Crown;
" " outlines functions and powers of TAFE Tasmania. The organisation is required to develop and maintain communication with employees and students and to advise the Minister of any significant development relating to the provision of vocational and further education. TAFE Tasmania is able to undertake commercial activities incidental to the provision of vocational and further education; undertake research incidental to its provision; form companies and participate in a trust with approval of the Minister and the Treasurer; and participate in a partnership, joint venture or other arrangement for the sharing of profits, with approval of the Minister;
" " provides for the appointment of a Board, which will be responsible to the Minister for the performance of the functions of TAFE Tasmania, the achievement of the objectives specified in its corporate plan and for ensuring that its business and affairs are conducted in accordance with sound business practice;

provides for the appointment of a chief executive officer to be responsible to the Board for the general administration and management of TAFE Tasmania;
" "
outlines accountability, financial and reporting requirements. The Minister is required to give the Board written policy expectations for TAFE Tasmania and may give it written directions from time to time;
" " allows the Minister to designate and name organisational units of TAFE Tasmania as institutes for the purpose of providing vocational and further education. The Minister will also have the power to abolish and amalgamate institutes;
" " enables TAFE Tasmania to establish advisory committees. It is required to establish an audit committee;
" " provides for employment of staff. In the main, employment of staff will be under the Tasmanian State Service Act 1984;
" " gives TAFE Tasmania the power to determine fees and charges payable for goods and services, and to determine exemptions. Money collected will be retained by TAFE;
" " gives power to TAFE Tasmania to issue guidelines in relation to access to any facilities and equipment owned or managed by it, the conditions of access, and any fees payable for access; and
" " provides the Minister will have the power to transfer Crown land to TAFE Tasmania, if the Treasurer, the Minister administering the Crown Lands Act 1976 and TAFE Tasmania agree. Other assets and liabilities can be transferred by ministerial order published in the Gazette.
